Terms (Conditions générales de vente)

Scope
These Terms ("CGV") govern the sale of web design, development, e-commerce, redesign, branding, and website care services by Old Boy Design (15 Rue de Crimée, 78800 Houilles, France) to any client who places an order through oldboydesign.com. Placing an order means you accept these Terms in full.
Services & prices
The services offered, and their prices, are described on the Pricing page and each package’s detail page, shown HT (hors taxes) and TTC (toutes taxes comprises, including France’s 20% TVA). Prices are fixed at the time of order. Work beyond the agreed scope is quoted separately, in writing, before it begins.
Ordering process
An order is placed by adding a package to the cart and completing checkout: contact details, billing address, project details, payment, and a review step where you confirm acceptance of these Terms and the Privacy Policy. An order confirmation with a reference number is issued once checkout is complete, saved on your own device — as explained in the Privacy Policy, this site has no server, so the order itself is not transmitted to us automatically. We receive and act on it once you contact us directly with that reference, at which point we confirm the order and issue an invoice.
Payment
Project packages may be paid in full or via a 30% booking deposit, with the balance invoiced before launch, as stated on each package’s page. Care Plans are billed monthly. At launch, payment processing on this site is a demonstration (mock) flow: no card is charged and no card data is stored or transmitted. Real payment processing will be enabled before any live order is taken, and this page will be updated at that point.
Delivery of services
All services sold are digital: there is no physical shipment, and the "digital delivery" line on every order is €0. Delivery timelines are estimates stated on each package’s page and confirmed in writing during the Discover stage; they depend in part on your timely provision of content and feedback.
Right of withdrawal (droit de rétractation)
Under Article L221-18 of the French Consumer Code, you have 14 days from your order date to withdraw without giving a reason, for services not yet performed. Because our services typically begin during that 14-day period (the Discover stage) at your request, placing an order and asking us to begin work constitutes your express, informed request that we start immediately, and you acknowledge under Article L221-28 (1°) that you lose the right to withdraw once the service has been fully performed. This is stated explicitly, and requires your active acknowledgement, at the review step of checkout. Where work has begun but is not complete, you remain entitled to withdraw and to pay only for the proportion of the service already delivered.
Intellectual property & ownership
On full payment, ownership of the final deliverables (code, design files, and content created for you) transfers to you, as described in each service’s "what’s included" and "what’s not included" sections. We retain the right to reference completed projects, in general terms, as part of our own portfolio, unless you ask us in writing not to.
Liability
Old Boy Design’s liability for any project is limited to the amount paid for that project. We are not liable for indirect damages (loss of revenue, loss of data unrelated to our work, reputational harm) arising from use of the delivered website, except where such liability cannot be excluded under French law.
Consumer mediation
If a dispute arises that we cannot resolve directly, and you are a consumer, you may refer the matter free of charge to the consumer mediator Old Boy Design is registered with: CNPM – Médiation de la consommation, 27 avenue de la Libération, 42400 Saint-Chamond, France, www.cnpm-mediation-consommation.eu — in accordance with Articles L616-1 and following of the French Consumer Code.
Governing law
These Terms are governed by French law. Any dispute not resolved through mediation is subject to the exclusive jurisdiction of the competent French courts.
